Privacy policy
1.Definitions
App: Any software/application developed by Scratchapp and Baku-Digital SPRL; Personal data: any information relating to an identified or identifiable natural person. It may include a person’s name, a picture, a phone number, an e-mail address, purchase and payment history, the location, etc.; User: any individual, or legal entity, who registers for use and uses services delivered by an App and who may have submitted personally identifiable information to Scratchapp; Data processing: any operation performed on the data such as collection, use, management or disclosure by means of transmission, dissemination or otherwise making available, blocking, erasure or destruction of personal data.
2.Collecting and processing personal data
Scratchapp may collect and process Personal Data and information on how the User uses the services provided by the App. The data are collected from the User or from the User’s device. Scratchapp may collect, store and process the location data of the User’s device when the User uses the App and take actions that use the location services made available through device’s mobile operating system, which makes use of cell tower triangulation, wifi triangulation, and/or GPS. When the User downloads or uses the App on its mobile device, information may be accessed from or stored in its mobile device. The information collected is stored in data centres operated by a third-party provider which may change from time to time. Therefore the location of the data centres may be communicated upon specific request.
If you create a Scratchapp account using a social network to log in, or connect with Facebook or another social network via the Scratchapp app, we may also receive some information about you from that network (e.g., your Facebook ID, name, profile picture, gender, friend list, birthdate, email address and Facebook registration date).
3.Purposes of the collecting and processing data
Scratchapp is specialized in developing softwares and applications in the sector of the augmented and virtual reality. It may provide augmented reality services to brands (Scratchapp’s clients) so that their marketing materials are scanable and show Users augmented reality content. Scratchapp collects information and process it in order to provide to User a great, personalised experience, and to report it to its clients.
Although some features of our sites or apps are available without creating an account, if you choose to register for an account to access additional Scratchapp features we may request some information, including, but not limited to, your name and email address. We may also collect information about you when you participate in certain activities such as filling out a form to take advantage of offers, completing a survey, participating in a contest or promotion or to sign up to receive one of our newsletters, communicating with us via third-party social media sites, requesting customer support, or otherwise communicating with us.
4.When and How We Share Your Information – Key Facts and How to Opt Out.
We may share your information, such as your device, IDFA/AAID, browser type, hashed email address, inferred age and gender, and location information (if you have consented to location access), with third parties including advertisers and partners, some of whom may use your data for the purposes of interest-based advertising, including demographic, behavioral, and geographic ad targeting or to provide localized services (with your prior permission or where otherwise permitted by applicable law).
We also may share your information with third-party service providers who perform services and functions on our behalf to support our interactions with you, including providing our products and services, administering surveys or contests, or communicating with you.
Additionally, some third parties (such as companies that advertise through our apps) may require you to provide your personal information in order to access their products, advertisements and offers. Any third party’s use of your personal information is governed by their own privacy policy. Please consult the privacy policies of those third parties to determine how they collect and use your personal information.
5.Conditions applicable to child’s consent
Scratchapp services are intended for users who are at least 16 years old. A user below the age of 16 years is required to get the consent of its parent or guardian before providing any personal information to Scratchapp. By using the App, the User is representing that he/she is at least 16 or that he/she has the specific consent of its parent or guardian.
6.Security
Scratchapp undertakes to take all the appropriate technical and organisational measures needed to protect one’s personal data from destruction, loss, modifications or disclosure. In order to guarantee this security, Scratchapp carries out, among others, regular back-ups.
7.Retention period
Personal information is held in Scratchapp system as long as it is necessary to provide access to the App. We can delete all your personal information data on request. However, if Scratchapp is subject to a legally binding requirement to retain User information for a specific period of time, this provision may override the User’s ability to require deletion.
8.Right to request a copy and right to request any inaccuracies to be corrected
Scratchapp shall take any reasonable step to ensure that the data is accurate and kept-up-to-date. It shall ensure that the data which is inaccurate or incomplete with respect to the purposes for which it is collected is erased or rectified. The User has the right to request a copy of the personal information which Scratchapp holds about the User, and to request free of charge any inaccuracies to be corrected. 9.Right to delete your personal data
You can delete all your personal data within the app by deleting your account. Alternatively, you can send a request to info@scratchapp.be and we will delete your account and all the personal data related to your account.
10.Disclosure of information
Scratchapp may share User’s information such as the username and name with other Users and with Scratchapp’s entities. The user expressly agrees that the personal data related to the User may be disclosed to Scratchapp’s client for marketing purposes. The Scratchapp may provide to its clients for marketing and strategic development purposes information in aggregate, so that no individual is being identified. The clients must also comply with the legislation when handling User’s personal data. Scratchapp may disclose information if it is needed to comply with any valid legal process, governmental request, applicable law regulation, if needed to investigate, remedy or enforce potential breaches in the use of the App, to protect the rights, property or the safety of Scratchapp, its Users, or third parties, to detect and resolving any fraud or security concerns. Scratchapp may provide to third parties if Scratchapp is acquired or if its legal structure undergoes a reorganisation or its business is transferred to another company. In that circumstances, Scratchapp may share information with this other company before and after the transaction closes. Except for the above, Scratchapp will not sell, rent or lease personal data to any third parties. Scratchapp does not for instance sell the names, e-mail addresses or personal demographic to mass marketers.
11.Changes to Scratchapp privacy policy
The present privacy policy may be updated from time to time. Major changes to the data collected and the use of them, will be notified through the website and the apps. If the User shall not agree with the changes, it shall not continue to use the app and/or the services.
